Residence Permit After Divorce in Turkey: The Three-Year Rule and Its Exceptions

A foreigner who divorces a Turkish citizen can keep living in Turkey (Türkiye) by moving from a family residence permit to a short-term residence permit, provided they have stayed in Turkey on a family residence permit for at least three years. The three-year condition does not apply where a court decision establishes that the foreign spouse was a victim of domestic violence. If the sponsoring spouse dies, no minimum period is required at all. These rules are in Article 34 of Law No. 6458 on Foreigners and International Protection.

Divorce ends the legal basis of a family residence permit, but it does not automatically end the right to stay. What matters is how long you have held the permit, who your spouse was, whether there are children, and whether you act before the old permit is cancelled. This guide explains each of those points and the alternatives when the three-year route is not open.

  • Family permit basis: marriage to a Turkish citizen or a lawful resident (Art. 34(1)).
  • After divorce from a Turkish citizen: short-term permit possible after at least 3 years on a family permit (Art. 34(6)).
  • Domestic violence: no 3-year requirement if victim status is established by a court decision (Art. 34(6)).
  • Death of the sponsor: short-term permit possible with no minimum period (Art. 34(7)).
  • Apply in Turkey: the switch from a family permit to a short-term permit is made at the governorate (Art. 22(1)(f)).
  • If nothing is done: the family permit is cancelled once its conditions end and no short-term permit is granted (Art. 36(1)(b)).
  • Work permit holders: a valid work permit is its own residence basis and is not affected by divorce.

How the family residence permit works

A family residence permit may be granted to the foreign spouse, the minor children and the dependent children of a Turkish citizen, of a person covered by Article 28 of the Turkish Citizenship Law (former citizens holding a Blue Card), of a foreigner holding a residence permit, or of a refugee or subsidiary protection holder (Art. 34(1)). It is issued for up to three years at a time and can never run longer than the sponsor's own permit.

The permit depends on the sponsor and on the marriage. The applicant must show that they live, or intend to live, with the sponsor, and that the marriage was not entered into to obtain the permit (Art. 35(3)). When the conditions "are not met or cease to be met", the permit is refused, cancelled or not renewed (Art. 36(1)(a)). A final divorce is the clearest case of a condition ceasing to be met.

The law softens this in one important way. Article 36(1)(b) provides that the family permit is cancelled where the conditions have ended and no short-term permit is granted afterwards. In other words, the statute itself anticipates that a person whose family permit loses its basis may move to a short-term permit instead of losing status.

When the permit's basis ends

EventEffect on the family permitProvision for staying
Final divorce from a Turkish citizenBasis endsShort-term permit after 3 years on a family permit; no period required for victims of domestic violence (Art. 34(6))
Death of the sponsorBasis endsShort-term permit with no minimum period (Art. 34(7))
Child on a family permit turns 18May continue or switchAfter 3 years on a family permit, may convert to a short-term permit on request (Art. 34(5))
Separation without divorceLiving-together condition in questionNo specific provision; assessed on the facts
Sponsor loses their own permitFamily permit cannot outlast itIndependent basis needed
Marriage found to be one of convenienceRefused or cancelled (Art. 37)None; time is not counted (Art. 37(3))

A divorce takes legal effect when the judgment becomes final, not when the petition is filed or when the spouses separate. During the proceedings the marriage continues in law. However, the family permit also requires cohabitation or the intention of it, and the authorities can check this at any time, so a long separation can itself raise questions before the divorce is final.

The three-year rule

Article 34(6) reads, in substance: in the event of divorce, a short-term residence permit may be granted to a foreigner who was married to a Turkish citizen, provided that they have stayed on a family residence permit for at least three years.

Each element matters:

  • "Married to a Turkish citizen." The provision is written for spouses of Turkish citizens. The position where the sponsor was a foreigner is discussed below.
  • "At least three years." What counts is time spent in Turkey on a family residence permit. Time on a tourist visa, a student permit or a short-term permit before the family permit was issued is not family-permit time. The length of the marriage itself is not the test: a five-year marriage with only two years on a family permit does not satisfy it.
  • "May be granted." The permit is discretionary. The general conditions for a short-term permit still apply — a valid passport, an address, accommodation meeting basic standards, health insurance, no entry ban or public order objection (Art. 32) — and the administration will look at whether the marriage was genuine.
  • The permit you receive is a short-term residence permit on the specific ground of "those who transfer from a family residence permit" (Art. 31(1)(ğ)), issued for up to two years at a time and renewable (Art. 31(2)).

This is a real advantage over other short-term grounds: you do not need to own property, run a business or justify a tourism stay. The basis is your past family life in Turkey.

The domestic violence exception

The second sentence of Article 34(6) removes the three-year condition where it is established by a relevant court decision that the foreign spouse was a victim of domestic violence. The purpose is plain: no one should have to remain in a violent marriage in order to keep their residence status.

What counts as a "relevant court decision" is not defined further in the statute. In practice the following are relied upon:

  • protective or preventive orders issued by a family court under Law No. 6284 on the Protection of the Family and the Prevention of Violence against Women;
  • a divorce judgment that finds the other spouse at fault on the ground of violence;
  • a criminal judgment convicting the spouse of an offence against the applicant.

A complaint to the police, a medical report or witness statements are valuable evidence but are not themselves court decisions; they are what a court decision is built on. If you are experiencing violence, applying for a protection order is therefore important both for your safety and for your residence status. Protection orders under Law No. 6284 are available to anyone in Turkey regardless of nationality or immigration status, and can be requested from the family court, the police or the prosecutor's office.

Separately, a victim of psychological, physical or sexual violence may not be deported until treatment is completed (Art. 55(1)(d)); see who cannot be deported from Turkey.

Death of the sponsoring spouse

If the sponsor dies, those who were staying on a family permit linked to that person may be granted a short-term residence permit without any minimum period (Art. 34(7)). This applies whatever the sponsor's nationality, and it covers children on family permits as well as the spouse. Apply promptly, with the death certificate, before the existing permit expires or is cancelled.

If your spouse was not a Turkish citizen

Article 34(6) refers only to foreigners married to Turkish citizens. Where the sponsor was another foreigner holding a residence or work permit, the statute contains no equivalent divorce rule. That does not mean there is no route:

  • the general power in Article 31(1)(ğ) to grant a short-term permit to "those who transfer from a family residence permit" is not limited by the sponsor's nationality, and Article 36(1)(b) contemplates a short-term permit after the family permit's conditions end;
  • the law allows any foreigner to apply for a different permit when the basis of the existing one ends (Art. 29), and to do so inside Turkey (Art. 22(1)(ğ));
  • in deciding, the administration must consider family ties in Turkey, the length of residence, the situation in the country of origin and the best interests of any child (Art. 25(1)).

The outcome is less predictable than for spouses of Turkish citizens. A well-documented application — showing length of residence, children, work or other ties — together with a second basis where one exists, is the prudent approach.

Fewer than three years: your alternatives

If you have less than three years on a family permit and the violence exception does not apply, you need an independent basis. The realistic ones:

  • Work permit. A valid work permit counts as a residence permit (Art. 27). If you are employed, your employer can apply; if you already hold one, the divorce does not affect it.
  • Short-term permit on another ground — qualifying immovable property, establishing a business, or study and training programmes (Art. 31(1)).
  • Student permit on enrolment at a higher education institution (Art. 38).
  • A child's best interests. Where you are the parent of a child in Turkey and no ordinary permit is available, a humanitarian residence permit can be granted on the ground of the child's best interests (Art. 46(1)(a)); see humanitarian residence permit in Turkey.
  • Long-term permit if you already have eight years of uninterrupted residence (Art. 42).

Timing matters more than anything else here. A switch has to be requested while you still hold lawful status. Once the family permit is cancelled and ten days pass without departure or a new application, you are exposed to a deportation order and, with it, an entry ban.

Children

  • Children who are Turkish citizens. A child of a Turkish parent is a Turkish citizen by descent and needs no permit. The foreign parent's own status is a separate question, but being the parent — especially the custodial parent — of a Turkish child is a weighty factor under Article 25(1) and under the right to family life.
  • Foreign children on family permits. Their permits are linked to the sponsor in the same way. If the sponsor dies, they may move to a short-term permit without a minimum period (Art. 34(7)). On turning eighteen, a child who has spent at least three years on a family permit may convert it to a short-term permit on request (Art. 34(5)).
  • School. A family permit gives the right to attend primary and secondary school until eighteen without a student permit (Art. 34(4)). If the family permit ends, make sure the child's new status is in place so that schooling is not interrupted.
  • Custody and travel. Custody is decided by the family court in the divorce. Taking a child abroad may require the other parent's consent or a court order, depending on the custody decision. For a child's family permit, the consent of a parent abroad who shares custody is required (Art. 34(3)).

How to make the switch

  1. Work out your family-permit time. Add up the validity periods of your family permit cards, from first issue to the present.
  2. Collect the documents: passport; current permit card; the finalised divorce judgment, or the death certificate; where relevant, the court decision establishing domestic violence; proof of address; health insurance; evidence of means; documents concerning children.
  3. Apply to the governorate. Transfers from a family permit to a short-term permit are among the applications that may be made inside Turkey (Art. 22(1)(f)). The application is entered in the e-ikamet system as a transfer between permit types and the file is submitted to the provincial directorate of migration management.
  4. Apply in time. Do so once the divorce is final and before your family permit expires or is cancelled. Do not wait for the next renewal date.
  5. Keep the application document as proof of lawful stay while the application is processed.
  6. If refused, the decision must be notified with information on remedies. An annulment action can be brought within 60 days, and the ten-day period for departure must be watched; see Residence Permit Rejected in Turkey.

Marriage of convenience investigations

Where there is reasonable suspicion, the governorate investigates, before granting or extending a family permit, whether the marriage was contracted solely to obtain a residence permit; it may also carry out checks after the permit is granted (Art. 37(1)–(2)). If the marriage is found to be one of convenience, the permit is refused or cancelled, and the time spent on it is not counted in calculating residence periods (Art. 37(3)).

A divorce shortly after obtaining a permit, or shortly after reaching the three-year mark, can prompt such an examination when the short-term permit is requested. A genuine marriage is shown by ordinary evidence: a shared registered address, joint tenancy or bills, photographs and travel together over time, children, and the divorce file itself, which usually tells the story of a real relationship that broke down.

Effect on a citizenship application

Under Article 16 of the Turkish Citizenship Law (No. 5901), a foreigner who has been married to a Turkish citizen for at least three years, and whose marriage continues, may apply for citizenship, provided the spouses live in family unity, the applicant does not act in a way incompatible with the marriage, and there is no obstacle in terms of national security or public order. The marriage must still exist: after a divorce this route is closed, and a pending application that has not been decided will normally fail because the marriage no longer continues.

There is one statutory exception. If the marriage ends because of the death of the Turkish spouse after the application has been made, the condition of living in family unity is not required.

After divorce, the remaining route is citizenship by residence, which requires five years of uninterrupted residence and the other general conditions. Whether particular periods of residence count is determined under the citizenship legislation.

Common mistakes

  1. Counting years of marriage instead of years on a family permit.
  2. Waiting for the permit to expire instead of applying for the switch once the divorce is final.
  3. Staying silent about the divorce. Civil registry records are available to the migration authorities; continuing to use a family permit after divorce risks cancellation and a finding that the permit was misused.
  4. Enduring violence without seeking a court order, in the belief that leaving the marriage means losing status.
  5. Relying on police reports alone for the violence exception, without a court decision.
  6. Leaving Turkey during the process without checking the effect on the permit and on re-entry.
  7. Assuming a pending citizenship application survives the divorce.

Frequently asked questions

Can I stay in Turkey after divorcing a Turkish citizen?

Yes, if you have stayed in Turkey on a family residence permit for at least three years: you may then be granted a short-term residence permit (Law No. 6458, Art. 34(6)). If you have less than three years, you need another basis such as a work permit, unless a court decision establishes that you were a victim of domestic violence.

Is my family residence permit cancelled automatically when I divorce?

The divorce ends the basis of the permit, and the law provides for cancellation where the conditions have ended and no short-term permit is granted (Art. 36(1)(b)). You should apply to transfer to a short-term permit once the divorce is final rather than wait for cancellation.

How is the three-year period calculated?

It is the time you have stayed in Turkey on a family residence permit. Periods on a visa, a student permit or another type of permit before the family permit was issued are not counted, and the length of the marriage itself is not the test.

What if I am a victim of domestic violence?

The three-year condition is not required where it is established by a relevant court decision that the foreign spouse was a victim of domestic violence (Art. 34(6)). Protection orders under Law No. 6284 are available regardless of nationality or immigration status.

What happens to my residence permit if my spouse dies?

Those staying on a family residence permit linked to the deceased sponsor may be granted a short-term residence permit without any minimum period (Art. 34(7)). Apply with the death certificate before the existing permit expires.

Does divorce affect my work permit?

No. A valid work permit is an independent basis of residence (Art. 27) and does not depend on your marriage. If your right to stay rested on the family permit and you are employed, a work permit obtained by your employer is one way to secure your status.

Can I stay in Turkey because my child is a Turkish citizen?

Being the parent of a Turkish child is not, in itself, a residence permit ground, but it is a significant factor the administration must consider, and where no ordinary permit is available a humanitarian residence permit may be granted on the basis of the child's best interests (Art. 46(1)(a)).

Will I be deported after divorce?

Not because of the divorce. Deportation becomes a risk only if your permit is cancelled or not renewed and you remain in Turkey without status beyond the permitted period. Applying for a new permit in time avoids that situation.

Can I still get Turkish citizenship after divorce?

Not through marriage: that route requires the marriage to be continuing. The alternative is citizenship by residence, which requires five years of uninterrupted residence and the other general conditions of the Turkish Citizenship Law.
