Turkish Citizenship Application Rejected: Reasons, Appeal and Reapplying

A rejected Turkish citizenship application can be challenged by an annulment lawsuit before the administrative court within 60 days of notification, and nothing in the law prevents a new application once the reason for the refusal has been addressed. The decision is taken by the Ministry of Interior under Article 19 of the Turkish Citizenship Law (No. 5901). The law states that meeting the conditions gives no absolute right to citizenship (Art. 10), so courts do not grant citizenship themselves — but they do examine whether the reason given for the refusal is real and lawful.

This guide covers the general route (five years' residence), the marriage route and, briefly, the exceptional routes including investment. It explains the conditions, the reasons applications fail, how to find out why yours did, and how to decide between suing and reapplying.

  • Where you apply: the governorate of your place of residence, or a Turkish mission abroad, in person or by a special power of attorney (Art. 37).
  • Who checks the conditions: the provincial citizenship application review commission (Art. 18).
  • Who decides: the Ministry of Interior; unsuitable applications are rejected by the Ministry (Art. 19).
  • No absolute right: fulfilling the conditions does not guarantee citizenship (Art. 10(1)).
  • Notification: decisions are notified to the applicant and to the application authority (Art. 41).
  • Remedy: annulment action within 60 days; a new application is also possible.
  • Later risk: citizenship obtained through false statements or concealment is cancelled (Art. 31).

Legal status of this guide. It reflects Law No. 5901 as currently in force. Details of the procedure, including which residence permits count, are set by the implementing regulation and by the Ministry's principles under Article 10(2), and are applied through administrative practice that changes. The routes to citizenship

Turkish citizenship is acquired at birth or afterwards (Art. 5). After birth, it is acquired by decision of the competent authority, by adoption, or by exercising a right of choice (Art. 9). The routes that concern foreign residents are:

RouteCore requirementDecisionBasis
General (residence)Five years' uninterrupted residence and seven further conditionsMinistry of InteriorArt. 11, 19
MarriageMarried to a Turkish citizen for at least three years, marriage continuingMinistry of InteriorArt. 16, 19
ExceptionalInvestors holding a residence permit under Art. 31(1)(j) of Law No. 6458, Turquoise Card holders, persons of exceptional service, persons whose naturalisation is considered necessary, recognised migrantsThe PresidentArt. 12
AdoptionMinor adopted by a Turkish citizen—Art. 17
Re-acquisitionFormer citizensMinistry or PresidentArt. 13–14, 43

Children born to a Turkish mother or father are Turkish citizens by descent and do not "apply" in this sense (Art. 7).

The general route: eight conditions

Article 11 requires that a foreigner who wishes to acquire citizenship:

  1. be an adult with capacity under their own national law or, if stateless, under Turkish law;
  2. have resided in Turkey without interruption for five years counting back from the application date;
  3. confirm by conduct that they have decided to settle in Turkey;
  4. have no illness constituting a danger to general health;
  5. be of good moral character;
  6. speak sufficient Turkish;
  7. have an income or profession providing for themselves and their dependants in Turkey;
  8. have no circumstance constituting an obstacle in terms of national security and public order.

What "residence" means. Residence is living in Turkey in accordance with Turkish law. An applicant may be outside Turkey for a total of no more than twelve months during the required residence period; periods spent abroad within that limit are counted as residence (Art. 15). The limit was raised from six to twelve months in 2017.

What "intention to settle" means. The statute speaks of conduct. Under the implementing rules, conduct such as acquiring immovable property, establishing a business, investing, working with a work permit, marriage to a Turkish citizen or having completed education in Turkey is treated as indicating an intention to settle, whereas residence on certain bases — notably for study, tourism, medical treatment, accompanying a student child, or as a protection applicant — is not accepted as residence for citizenship purposes. Which of your residence permits count is therefore decisive and should be checked before applying.

The marriage route: conditions

Marriage to a Turkish citizen does not confer citizenship directly. A foreigner who has been married to a Turkish citizen for at least three years and whose marriage continues may apply (Art. 16(1)). The applicant must:

  • live in family unity;
  • not engage in any activity incompatible with the marital union;
  • have no circumstance constituting an obstacle in terms of national security and public order.

There is no five-year residence requirement and no language or income condition in Article 16. If the marriage ends through the death of the Turkish spouse after the application has been made, the family-unity condition is not required (Art. 16(2)). A person who acquired citizenship by marriage keeps it if the marriage is later declared void, provided they entered the marriage in good faith (Art. 16(3)).

The marriage must be genuine, and that is what the authorities test; see Residence Permit After Divorce in Turkey for what happens when a marriage ends before a decision.

How an application is processed

  1. Application to the governorate of the place of residence, in person or by a special power of attorney (Art. 37), with the prescribed documents and payment of the service fee (Art. 45).
  2. Provincial commission. For the general and marriage routes, a citizenship application review commission in the province determines whether the applicant meets the conditions (Art. 18). This is where the interview takes place — on language, knowledge of life in Turkey and, for spouses, the marriage.
  3. Police and security enquiries. The file is checked against criminal, security and intelligence records. Public bodies must supply information without delay (Art. 38).
  4. File sent to the Ministry. A citizenship file is prepared for those who meet the conditions and sent for decision (Art. 19(1)).
  5. Ministry's examination and decision. Those found suitable may acquire citizenship by the Ministry's decision; the requests of those not found suitable are rejected by the Ministry (Art. 19(1)).
  6. Notification to the applicant and to the application authority (Art. 41). A positive decision takes effect from its date (Art. 20(1)).

The law sets no time limit for the decision. Exceptional-route applications are conducted by the Ministry and decided by the President (Art. 12, 19(2)).

Why applications are rejected

ReasonRoutes affectedWhat usually lies behind it
National security or public order obstacleAllCriminal record or pending case in Turkey or abroad; adverse security or intelligence information; past deportation or restriction code
Residence requirement not metGeneralMore than twelve months abroad in the five years; gaps between permits; years spent on permits that do not count
Intention to settle not shownGeneralNo work, property, business or family ties; residence only on short-term tourist permits
Insufficient TurkishGeneralUnable to hold a basic conversation at the commission interview
Insufficient income or professionGeneralNo documented lawful income
Good moral characterGeneralConvictions, unpaid public debts, conduct recorded by the police
Family unity not establishedMarriageSpouses living at different addresses; inconsistent interview answers; findings of a home visit
Activity incompatible with the marriageMarriageConduct recorded by the authorities that contradicts a genuine marital life
Investment conditions not met or not maintainedExceptionalValuation, annotation or holding-period defects
Formal defectsAllMissing or inconsistent documents; identity discrepancies between records

The security ground deserves emphasis. For the exceptional route the law says expressly that applications by those with a national security or public order obstacle are rejected by the Ministry (Art. 12(2)); for the general and marriage routes the absence of such an obstacle is a condition. It is also the ground on which the administration gives the least explanation.

Finding out the reason

Rejection notices are frequently short — a statement that the application "was not found appropriate", sometimes with a reference to an article of the law. You need more than that to decide what to do.

  • Ask in writing. Request the reasoned decision and the legal basis from the provincial directorate of population and citizenship. A request under the right-to-information legislation can also be made.
  • Review your own file honestly. Days abroad, permit types and gaps, any police contact, any unpaid fines, any discrepancy in names or dates across your documents.
  • The court file. In a lawsuit, the court requires the administration to produce the file on which the decision was based. For security-based refusals this is often the only way the reason comes to light, although some material may be shown to the court alone.

The annulment lawsuit

  1. Time limit. Sixty days from written notification of the rejection (Law No. 2577, Art. 7). A request to the administration to reconsider, made within that period, suspends it until the administration replies or 30 days pass without a reply (Art. 11).
  2. Court. The administrative court; since the decision is taken by the Ministry of Interior, the Ankara administrative courts are as a rule competent.
  3. What the court reviews. Citizenship is a matter of sovereign discretion and Article 10 says that meeting the conditions confers no absolute right. Judicial review is nevertheless available: the court examines whether the decision has a lawful and factually accurate reason, whether the procedure was followed, and whether the discretion was used for the purpose the law intends. It does not weigh whether the applicant "deserves" citizenship and cannot grant it.
  4. Where cases succeed. Where the stated reason is factually wrong — the residence calculation is mistaken, a criminal record relied upon belongs to someone else or ended in acquittal, the spouses do in fact live together — or where no concrete reason exists at all.
  5. Where they do not. Where the administration produces specific information supporting a security or public order assessment, courts generally defer to it.
  6. Result. Annulment requires the Ministry to re-examine the application in light of the judgment.
  7. Duration. Typically a year or more including appeal.

Reapplying

The law sets no waiting period and no limit on the number of applications. A new application is the right route where the obstacle can be removed:

  • Residence: wait until five clean years, with no more than twelve months abroad, have accrued on permits that count.
  • Language: study and reapply; the commission interview is repeated.
  • Income: document lawful, regular income — employment contract, social security record, tax returns, company accounts.
  • Marriage: reapply when cohabitation can be demonstrated consistently — same registered address, joint household evidence, consistent accounts.
  • Criminal or security record: obtain documents showing acquittal, non-prosecution, expungement or the lifting of a restriction; a new application before the underlying record is resolved will fail again.

Every new application is checked against the previous file. Inconsistent statements between applications are themselves a problem, and deliberate misstatement is a ground for later cancellation.

Applications that are stuck, not refused

Because the law sets no deadline for the decision, many applicants wait for long periods at the stage of security enquiries. There is no automatic approval by lapse of time. The options are limited but real:

  • check that nothing is missing from the file and that your address and contact details are current;
  • make a written enquiry through the governorate;
  • submit a formal written request for a decision; if the administration does not reply within 30 days, that silence can be treated as an implied refusal and challenged in court (Law No. 2577, Art. 10) — a step to be weighed carefully, since it converts a pending application into a dispute.

Cancellation after citizenship is granted

A decision granting citizenship is cancelled by the authority that issued it if it came about through the applicant's false statement or concealment of important matters forming the basis of acquisition (Art. 31). The consequences are severe:

  • the cancellation takes effect from the date of the cancellation decision and applies also to a spouse and children who acquired citizenship through the person concerned (Art. 32);
  • the person is thereafter treated as a foreigner, and where liquidation of assets is considered necessary this is stated in the decision and must be completed within one year (Art. 33(1));
  • if the cancellation is challenged in court, liquidation is deferred until the end of the case (Art. 33(2)).

Separately, citizenship decisions are withdrawn if it later emerges that they were made without the legal conditions being met or in duplicate (Art. 40). The practical lesson: accuracy in the application — about marital life, residence, identity, previous names and nationalities, and criminal history — matters long after the passport is issued.

Common mistakes

  1. Counting years on student or tourist-purpose permits towards the five years.
  2. Exceeding twelve months abroad in the residence period.
  3. Applying by marriage while living apart, or giving inconsistent answers at separate interviews.
  4. Not disclosing a foreign conviction or a previous name.
  5. Letting the 60 days pass while waiting for an informal explanation.
  6. Reapplying immediately with the same file.
  7. Assuming the investment route is purely transactional; the security check applies to it as well.

Frequently asked questions

Can I appeal a rejected Turkish citizenship application?

Yes. The rejection is an administrative decision that can be challenged by an annulment action before the administrative court within 60 days of notification. The court reviews whether the reason for the refusal is lawful and factually correct; it does not itself grant citizenship.

Why was my Turkish citizenship application rejected?

The most common reasons are a national security or public order obstacle, not meeting the five-year residence requirement, too much time abroad, not showing an intention to settle, insufficient Turkish or income, and, for spouses, failure to establish that the couple live in family unity.

Can I reapply for Turkish citizenship after a rejection?

Yes. The law sets no waiting period. A new application should be made once the reason for the earlier refusal has been resolved, since it will be assessed against the previous file.

How long can I be outside Turkey during the five years?

A total of no more than twelve months within the required residence period. Time abroad within that limit is counted as residence (Art. 15).

Does marriage to a Turkish citizen guarantee citizenship?

No. Marriage does not confer citizenship directly. After three years of continuing marriage you may apply, and you must show family unity, no conduct incompatible with the marriage, and no national security or public order obstacle. Meeting the conditions gives no absolute right.

How long does a Turkish citizenship application take?

The law sets no deadline. Duration depends on the route, the province and above all the security enquiries; many applications take a year or longer.

Will the authorities tell me the reason for the refusal?

The decision must be notified, but the notice is often brief. You can request the reasoned decision in writing, and in a lawsuit the court obliges the administration to submit the file on which the refusal was based.

Does a criminal record prevent Turkish citizenship?

It can. Good moral character and the absence of a national security or public order obstacle are conditions. The effect depends on the nature and outcome of the case; an acquittal or a decision not to prosecute should be documented in the file.

Can Turkish citizenship be taken away after it is granted?

Yes, if it was obtained through false statements or by concealing important matters (Art. 31). Cancellation also affects a spouse and children who acquired citizenship through the person concerned.
