Fake Residence Permits and Forged Documents in Turkey: Penalties and Defences

Using a forged official document in Turkey (Türkiye) — a fake residence permit, visa, passport stamp, diploma or title deed — is punishable by two to five years' imprisonment, whether you made it, altered it or only used it (Turkish Penal Code No. 5237, Art. 204(1)). Forging and using a private document, such as a rental contract or bank letter, carries one to three years (Art. 207). Making a false statement to a public official who is drawing up an official document carries three months to two years or a judicial fine (Art. 206). For a foreigner the criminal case is only half the problem: using false information or forged documents in entry, visa or residence procedures is a ground for refusal and cancellation of permits and for deportation under the Law on Foreigners and International Protection.

Most foreigners who end up in these cases did not forge anything themselves. They paid an "agent" or "consultant" who promised a residence permit, an address registration or an insurance policy, and received paper that turned out to be false. This guide explains the offences, how such cases arise, the defences — especially lack of knowledge — and the immigration consequences that follow regardless of the criminal outcome.

  • Forgery of an official document: forging, altering or using — two to five years (Art. 204(1)).
  • Documents valid until proved false: sentence increased by half (Art. 204(3)).
  • Forgery of a private document: one to three years; using one knowingly is punished the same (Art. 207).
  • False statement to an official drawing up a document: three months to two years or a fine (Art. 206).
  • With another offence: punished separately for forgery and for that offence (Art. 212).
  • Using someone else's identity to avoid investigation: punished under the slander provisions (Art. 268).
  • Immigration: false information or forged documents lead to refusal, cancellation and deportation (Law No. 6458).
  • Citizenship: obtained through false statements or concealment can be cancelled.

Legal status of this guide. It reflects the Turkish Penal Code and the Law on Foreigners and International Protection (No. 6458) as in force. Whether a particular paper is an "official" or "private" document, and whether it was capable of deceiving, are decided case by case in light of Court of Cassation practice. Official and private documents

The Penal Code treats forgery of official documents far more severely than forgery of private ones, so the first question in any case is which kind is involved.

Official documentPrivate document
What it isA document drawn up by a public official in the course of dutyAny other written document with legal significance
ExamplesPassport, visa, entry and exit stamps, residence permit, work permit, identity card, driving licence, title deed, court documents, notarial deeds, civil registry records, state university diploma, tax and social security records, apostilleRental contract, employment contract, private company letter, invoice, private bank reference, private insurance policy, invitation letter
Forging or altering2 to 5 yearsPunishable only if the document is also used
Using a forged one2 to 5 years1 to 3 years, if used knowing it is forged
Public official as offender3 to 8 years (Art. 204(2))—

Documents issued by foreign public authorities — a foreign passport, a foreign diploma, a foreign criminal record certificate or marriage certificate — are treated in Turkish practice as official documents for these purposes. A forged home-country document submitted to a Turkish authority is prosecuted here.

Certain official documents are, by law, valid until proved to be forged — notarial deeds drawn up in the drafted form and court records are the typical examples. For these the sentence is increased by half (Art. 204(3)).

What conduct is punished

For official documents, Article 204(1) lists three alternative acts, each sufficient by itself:

  1. forging an official document;
  2. altering a genuine official document in a way that will deceive others;
  3. using a forged official document.

The person who presents a fake residence permit card at a police check has "used" it, even though someone else printed it. A person who commissions a forgery and supplies a photograph and personal details for it is treated as taking part in the forging.

For private documents, Article 207 punishes a person who forges or deceptively alters a private document and uses it, and a person who uses a forged private document knowing it to be forged.

Related provisions:

  • Destroying, damaging or concealing a genuine official document: two to five years (Art. 205); a private document: one to three years (Art. 208).
  • Combination with another offence. If a forged document is used in committing another offence — typically fraud — the offender is punished separately for both (Art. 212).
  • Using another person's identity. A person who, in order to prevent an investigation or prosecution against himself or herself, uses someone else's identity or identity details is punished under the provisions on slander (Art. 268). Giving a brother's or friend's name at a police check is not a harmless lie.

How foreigners end up in these cases

  • Fake residence or work permit cards sold by intermediaries, sometimes with a genuine-looking number belonging to someone else. They fail at the first electronic check.
  • Forged entry and exit stamps or altered dates in a passport, to hide an overstay or to simulate the required presence in Turkey.
  • Fake rental contracts and address documents submitted with a residence permit application: a contract for a flat the applicant never rented, sometimes with a forged notary stamp — which turns a private document into a forged official one.
  • Fake health insurance policies, bank statements or proof of income in a permit file.
  • Forged diplomas, transcripts and equivalence documents for work permits, university admission or professional recognition.
  • Forged criminal record certificates, birth and marriage certificates, and forged apostilles on them, in citizenship and family files.
  • Forged or altered title deeds and valuation reports in property and investment files.
  • Passports: travelling on another person's passport, a passport with a substituted photograph, or a forged visa.
  • Forged driving licences presented at a traffic stop or for exchange. See our guide to driving in Turkey with a foreign licence.

Turkish authorities verify electronically. Residence and work permits, address records, insurance policies, title deeds and notarial documents all sit in connected databases, and officials check the database, not the paper. A fake that looks perfect is detected because no record lies behind it.

False statements to officials

A person who makes a false declaration to a public official who is authorised to draw up an official document is punished with three months to two years' imprisonment or a judicial fine (Art. 206). The offence is committed where the official document is created on the basis of the declaration and serves to prove its truth — a false declaration of identity, marital status, address or parentage recorded by a registry or notary.

Not every untrue statement in an application form is this offence. But a false statement that is not a crime under Article 206 can still be "false information" for immigration purposes, with the consequences described below. And the offence can combine with others: a marriage entered into only to obtain residence or citizenship is dealt with under the immigration and citizenship rules described in our guide to marriage-of-convenience investigations.

Defences

No knowledge, no intent

Forgery offences require intent. A person who used a document believing it to be genuine has not committed the offence. This is the central defence for clients who obtained papers through an intermediary. It is assessed on the evidence:

  • Did you attend a government office in person, give fingerprints, pay official fees? Or did you hand over a passport and money in a café?
  • Was the price and speed plausible for the genuine procedure?
  • Do you have messages, receipts, the agent's name, office address and bank account?
  • Did you use the document openly and repeatedly at official checks, as someone confident of it would?
  • Did you report the agent when you learned the truth?

A person who never set foot in the migration office and paid cash to a stranger for a residence card will find it difficult to persuade a court of good faith. A person who was taken to what appeared to be an official appointment and has the correspondence to show it is in a much stronger position.

Not capable of deceiving

The forgery must be capable of deceiving an ordinary person. A crude alteration that anyone would notice at first glance, without special examination, does not constitute the offence. Courts normally decide this by examining the document themselves and through expert examination; the defence should ask for it.

Not a "document"

An unsigned photocopy, a draft or a text with no apparent issuer may not qualify as a document at all. A colour copy presented as an original can, however, be treated as a document if it gives that impression.

Official or private?

Reclassification from official to private document changes the sentencing range from two-to-five years to one-to-three, and brings different procedural options.

One offence or several

Several forged documents used in one application, or the same document used repeatedly, raise questions about whether there is a single offence, a continuing offence with an increase, or several. The answer changes the sentence significantly.

Sentencing

For a first offender with a sentence at or near the minimum, the court may defer the announcement of the verdict or suspend the sentence, so that no prison time is served. These outcomes still leave a record that the migration authorities see.

Investigation and trial

Cases usually begin at a counter or a checkpoint: the migration office, the airport, a police identity check, a notary or the land registry. The document is seized and sent for examination; the holder is taken to give a statement.

  • Your rights: an interpreter, a lawyer before and during questioning — appointed free on request — and silence. See our guide to the rights of a foreigner arrested in Turkey.
  • The first statement should set out, accurately and in detail, how the document was obtained. Naming the intermediary at the outset both supports the defence and may lead to the real forger.
  • Detention. Forgery of an official document is tried in the heavy penal court in many configurations and the criminal court of first instance in others. Pre-trial detention is ordered in cases suggesting an organised operation or multiple documents; individual users are more often released under judicial control.
  • Parallel immigration action. The police notify the migration authority, which acts on its own timetable. A deportation decision can arrive while the criminal investigation has barely started.

Immigration consequences

The Law on Foreigners and International Protection attaches consequences to false information and forged documents at every stage, independently of any conviction.

StageConsequence
At the borderEntry is refused to those whose passport, visa or residence or work permit is found to have been obtained fraudulently or to be forged.
VisaA visa obtained through deception is cancelled.
Residence permitAn application supported by false documents is refused; a permit already granted is cancelled.
Work permitRefused or cancelled where the application contained false or misleading information or documents.
DeportationA deportation decision is issued for those who use false information and forged documents in procedures for entry to Turkey, visas and residence permits (Art. 54).
Entry banDeportation is accompanied by an entry ban, which can run for years.
CitizenshipA decision granting citizenship is cancelled if it was obtained through false statements or concealment of material facts, with effects on family members who acquired through the same person.

These are administrative decisions with their own remedies and short deadlines — seven days to appeal a deportation order to the administrative court. An acquittal in the criminal case helps, but the administrative court will ask its own question: were false documents used in the procedure? See our guides to appealing a deportation order, residence permit refusals, entry bans and cancellation of Turkish citizenship.

The principle of non-refoulement and the protected categories apply here as elsewhere. People fleeing persecution often travel on false papers because they have no alternative; the Law's provisions on applicants for international protection take that into account, provided they come forward and explain. See our guide to who cannot be deported from Turkey.

Told that your permit, stamp or supporting document is false? Do not give a statement without a lawyer and do not rely on the agent who supplied it. Message Yayla Law on WhatsApp or use the contact form with a photograph of the document and how you obtained it.

If an agent gave you a fake document

You may be both a suspect and a victim. The person who took your money for a document he knew to be worthless has committed fraud, and probably forgery as well.

  1. Stop using the document the moment you doubt it. Each further use is a further act.
  2. Preserve everything: messages, voice notes, payment records, the agent's telephone number, photographs of the office, names of other clients.
  3. Take advice before going to the authorities. A voluntary approach with a lawyer, a prepared account and a complaint against the agent is received very differently from discovery at a checkpoint. It is the strongest evidence of good faith available to you.
  4. File a criminal complaint against the agent. Our guide to filing a fraud complaint in Turkey explains how.
  5. Regularise your status through the genuine procedure if a basis for residence exists, or plan a lawful departure. Time spent in Turkey on a fake permit is time without a permit; the overstay consequences are covered in our guide to overstaying in Turkey.

Correcting a problem before it is discovered

Some clients know, or suspect, that something in a past application was untrue: an address they never lived at, an insurance policy that was cancelled, a document supplied by a previous consultant. The options depend on what the document was, whether it was official or private, whether a permit was granted on the strength of it and what your status is now. In general terms:

  • do not repeat or rely on the document in a renewal;
  • do not "replace" it with a backdated genuine one — that is a new offence;
  • base the next application entirely on genuine, current documents;
  • take advice on whether disclosure is advisable in your situation before the renewal is filed.

How to avoid fake documents

  • Residence permits are applied for through the official online system and require an appointment at the provincial migration directorate, where you attend in person. The card is posted to your registered address. No one can "get" you a permit without this.
  • Work permits are applied for by the employer through the Ministry's electronic system. You can verify a permit online.
  • Verify through e-Devlet, the government portal, where residence permits, address registration, insurance and title can be checked and barcoded documents validated.
  • Title deeds are checked at the land registry directorate, not on paper supplied by a seller.
  • Pay official fees yourself, to the tax office or bank, and keep the receipts.
  • Use a lawyer registered with a bar association — you can check registration — rather than an unlicensed consultant. Only lawyers may represent clients in legal proceedings.
  • Be suspicious of guarantees, speed and cash. Genuine procedures have published fees and take the time they take.

Frequently asked questions

What is the penalty for using a fake document in Turkey?

Two to five years' imprisonment for a forged official document such as a permit, passport or diploma; one to three years for knowingly using a forged private document.

I did not make the document. Am I still guilty?

Using a forged official document is punished like forging it — but only if you knew it was forged. Lack of knowledge is a defence that must be supported by evidence of how you obtained it.

An agent gave me a fake residence permit. What should I do?

Stop using it, keep all evidence of your dealings with the agent, take legal advice, and consider approaching the authorities with a complaint against the agent before the document is discovered.

Will I be deported for a fake document?

Using false information or forged documents in entry, visa or residence procedures is a statutory ground for deportation, usually with an entry ban. The decision can be appealed within seven days.

Is a fake rental contract a serious offence?

A rental contract is a private document: one to three years if forged and used. If a notary's stamp or signature is forged on it, it becomes forgery of an official document.

Is a forged foreign diploma or certificate prosecuted in Turkey?

Yes. Documents issued by foreign public authorities are treated as official documents when used before Turkish authorities.

What if the forgery is obviously fake?

If it could not deceive anyone on ordinary inspection, the offence is not made out. The court examines the document to decide this.

Can I avoid prison?

A first offender sentenced at the lower end may receive a deferred or suspended sentence. The immigration consequences apply regardless.

Can citizenship be taken back for false documents?

Yes. Citizenship obtained through false statements or concealment of material facts can be cancelled, affecting family members who acquired through the same person.
